Shari'ah-compliant financing for energy projects: a call for standardisation of Islamic finance contracts

Abstract

This chapter attempts to present a legal analysis to produce some useful insights
for understanding the nature of standardisation efforts and clarifying the objectives and legal trajectory of Islamic finance in the energy sector for just and low-carbon energy transition. Most of the countries which are implementing Shari’ah-compliant financing for energy projects follow civil law systems, some follow common law, and many are hybrid legal systems. The nature of these systems differs from country to country and, indeed, from continent to continent. Hence, a detailed analysis on the legal mechanisms of the standardisation challenges is required to understand how the Interest Free Loan (IFL) can be facilitated in the energy industries.
