Abstract
This chapter discusses the appellate review of administrative decisions in cartel cases in the EU and its Member States. The term “judicial review” is used in a general sense, rather than focusing on the concept of a standard of review. The paper provides an overview of current trends in European cartel law over a three-year period. Part II, entitled “Judicial deference versus judicial interventionism”, mirrors recent developments in connection with the Courts’ powers of review. Part III, entitled “Effective judicial protection: procedural guarantees”, delves into issues of fundamental rights and discusses the checks and balances that apply to the competences and powers conferred to the Commission.
