Feminist statutory drafting

Abstract

This chapter sets out the principles of feminist statutory drafting, after first exploring statutory drafting as a specialised legal skill that translates policy and principles into Bills to be made law. A particular challenge encountered in this project was how to draft laws that are ‘feminist’ enough. This chapter draws from the theory and practice of statutory drafting, alongside our experiences drafting legislation for the Australian Feminist Legislation Project, to develop a set of principles and practices that in our view should form part of feminist statutory drafting.
