EU migrant children, their primary carers and the European Court of Justice: access to education as a precursor to residence under community law

Abstract

Examines issues regarding the social and economic rights of EU nationals and their family members arising from EC law on freedom of movement, by reference to two cases referred to the European Court of Justice by the Court of Appeal for preliminary rulings on questions concerning the rights to residence and entitlement to housing assistance of migrant mothers, who were neither workers nor self-sufficient, as the primary carer of EU migrant children who were accessing education in the UK.
