African customary law of intestate succession and gender (in)equality

Abstract

In this contribution the constitutionality of the rules of African customary law of intestate succession with specific reference to the question of gender equality viz a viz the principle of male primogeniture will be analysed. The analysis will entail an exposition of, and an investigation into, the core principles of African customary intestate succession, relevant aspects of the constitution,
recently passed legislation and applicable case law.
