Australian criminal justice systems continue to struggle with the problem of how best to deal with offenders considered at high risk of causing serious harm. This project critically examines the international law, constitutional and criminal justice dimensions of current Australian preventive detention schemes. It also analyses alternative international approaches to the management of high risk offenders, such as orders for lifelong restriction and treatment programs mandated through mental health legislation in order to find the most effective and workable strategies.
