Biography

Dr. Brandon D. Stewart is a Lecturer at Monash University Faculty of Law. He is also affiliated with the Centre for Commerial Law and Regulatory Studies (CLARS) and the Australian Centre for Justice Innovation (ACJI).

Brandon is a doctrinal, comparative, interdisciplinary and empirical legal researcher, specialising in the law of torts and access to justice issues. His recent scholarship has examined unique public duties of care for public authorities to avoid climate change harms; conceptualised liability in battery for noise-related interferences; and evaluated innovative service delivery models within community legal clinics designed to improve legal pathways. He is currently working on empirical projects related to private law jurisprudence in apex courts and a doctrinal project on pure economic loss liability in Australia post-Mallonland. Brandon has recieved funding from the Fulbright Foundation and Social Sciences and Humanities Research Council, and his research is featured in leading general and specialist law journals, such as the UNSW Law Journal and Tort Law Review. 

Brandon is an award-winning educator and teaches Torts and Litigation and Dispute Resolution in the Law Faculty's JD and/or LLB programs. He is deeply committed to law student success and wellbeing and co-ran the first Canadian conference on 'Teaching Wellbeing in Law.'

Brandon is a graduate of Wilfrid Laurier University (BA, Gold Medal), the University of Ottawa (JD, Silver Medal) and Yale Law School (LLM as a Fulbright Fellow and JSD). He has held visiting and academic positions at internationally-recognised law schools, including the University of Ottawa's Faculty of Law and Sydney Law School. Prior to entering academia, Brandon practiced as a commercial litigator and worked as a research fellow for a community legal clinic in Canada.

Brandon is Canadian and enjoys Melbourne's weather (really!) and coffee culture (sorry, Tim Hortons). He is currently accepting recommendations for what AFL team to cheer for.

Consulting

Brandon has worked closely with, and consulted for, community legal clinics in Canada for over a decade on innovative service delivery models to improve legal pathways for marginalised communities. These initiatives received generous support from Legal Aid Ontario and Immigration, Refugees and Citizenship Canada.
