Biography

Ann was the inaugural Director of the Centre for Commercial Law and Regulatory Studies (CLARS), established in September 2014 following the merger of the former Monash Centre for Regulatory Studies and the Commercial Law Group, of which she was the head. In the past Ann has held a number of leadership roles in the faculty, including Associate Dean (Postgraduate Studies), Associate Dean (Research) and Director of Higher Degrees by Research. She served as a member of the Monash University Intellectual Property Committee for many years from 1995. Ann is a member of the Intellectual Property Committee, Business Law Section of the Law Council of Australia (appointed 2004). Prior to becoming an academic, Ann was a partner in a law firm, practising in areas of general commercial law, property law, wills and estates.

Ann has been a Chief Investigator on four Australian Research Council grants:

  • Designing World-class Venture Capital Programs to Support Commercialisation of Australian Research During and Beyond an Economic Crisis (2013-2016);
  • Balancing Intellectual Property and Other Rights in Tangible Research Materials Used in Biomedical Research (2001-2002);
  • Legal and Policy Issues Involved in the Access to Tangible Research Materials Used for Biotechnological Research in Public Research Institutions (2000); and
  • Universities and the Ownership and Exploitation of Intellectual Property Rights: A Theoretical, National and Comparative Study (1995, 1996).

Professor Ann Monotti is the principal author of Universities and Intellectual Property: Ownership and Exploitation (Oxford University Press, New York, 2003), a co-author of three editions of Australian Intellectual Property Law (3rd ed, Cambridge University Press, 2016) and a co-author of Innovation and Venture Capital Law and Policy (Federation Press, forthcoming 2016). She co-edited Business Innovation and the Law: Perspectives from Intellectual Property, Labour, Competition and Corporate Law (Edward Elgar Publishing, UK, 2013) and a Special issue of the Monash University Law Review on Intellectual Property Law (2012), volume 38 Issue 1. Other projects are: Monotti (ed), Employment Law and Intellectual Property Law (Edward Elgar Publishing, UK, 2018)  – part of the Critical Concepts in Intellectual Property Law series) and co-authorship of Commercialisation of Intellectual Property (LexisNexis Butterworths), due to be published in 2018.

Her writing has been considered by the High Court of Australia:

  • D'Arcy v Myriad Genetics Inc [2015] HCA 35, [21], [24] and
  • Northern Territory v Collins (2008) 235 CLR 619, [121]

and in various decisions of the Federal Court of Australia including:

  • University of Western Australia v Gray (No 20) (2008) 246 ALR 603 (French J)[158]-[159], [1367];
  • University of Western Australia v Gray (2009) 179 FCR 346, [149], [169], [187], [195]; and
  • Bristol-Myers Squibb Co v F H Faulding & Co Ltd (2000) 170 ALR 439, 471.
