Description

The Victorian Charter provided for a review of its operation within 8 years of coming into force. My submission addresses issues, including: (a) the operation of rights compatible interpretation (s 32) and its interaction with limitations provisions (s 7(2)); (b) the Momcilovic litigation in the Victorian Court of Appeal and the High Court of Australia; (c) suggested amendments to the Victorian Charter; (d) and embedding a human rights culture within Victoria.
